Terms and Conditions

• Builder — a user who lists instruments, models, and customization options and offers custom builds through the Platform.
• Artist — a user recognized as the owner of an instrument, as displayed on the Platform.
• Model — a design published by a Builder.
• Item — a specific instance of a Model with a defined set of customization options.
• Order — a request submitted through the Platform for a custom build based on an Item's configuration.
• Content — any text, images, media, reviews, links, or other materials submitted to the Platform by users.

You must be at least the age of majority in your jurisdiction, or have the consent of a parent or legal guardian, to use the Platform. By using the Platform, you represent that you meet this requirement and that the information you provide is accurate and complete.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

Builders may be subject to a verification process before their profiles become publicly visible. Verification is intended as a basic trust measure and does not constitute an endorsement, guarantee, or warranty by us regarding a Builder's identity, qualifications, products, or conduct. You are responsible for your own due diligence before entering into any arrangement with a Builder.

You agree not to:

• Violate any applicable law or the rights of others.
• Submit false, misleading, fraudulent, or infringing Content.
• Impersonate any person or entity, or misrepresent your affiliation or ownership.
• Interfere with, disrupt, or attempt to gain unauthorized access to the Platform or its systems.
• Use the Platform to harass, abuse, or harm other users.
• Use automated means to scrape or collect data from the Platform without our permission.

We may remove Content or restrict access at our discretion if we believe these Terms have been violated.

The Platform provides messaging features, including the ability to share attachments. You are responsible for the content of your messages and any files you share. Do not use messaging to transmit unlawful, harmful, or infringing material.

The Platform, including its design, features, and branding, is owned by us and protected by applicable intellectual property laws. Except for your own Content, nothing in these Terms grants you any right to use our intellectual property without our prior written consent.

The Platform may contain links to, or embed content from, third-party services. We do not control and are not responsible for third-party content, services, or practices. Your use of third-party services is subject to their own terms.

The Platform is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or secure.

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of the Platform, any Order, any transaction with a Builder, or any ownership record.

You agree to indemnify and hold harmless CustomShop.build and its affiliates from any claims, liabilities, damages, and expenses arising out of your use of the Platform, your Content, or your violation of these Terms or the rights of any third party.

We may suspend or terminate your access to the Platform at any time, with or without notice, if you violate these Terms or for any other reason at our discretion. You may stop using the Platform at any time.

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute arising under these Terms will be subject to the exclusive jurisdiction of the courts located in Ontario, Canada.
